Espectro has beend designed to give artists from all over the world a forum to showcase their work to the widest audience possible. In oder to promote your artwork Espectro offers an array of very powerful features like automatic submission of your work to search engines, access to our mailing lists, and distribution of your artwork as electronic postcards. All of those features could potentially be misused to spread for example obscene or hate material.

Obviously, this is not what we had in mind when we conceived this site. We understand that the borders between what is art and what is not cannot be determined clearly. But for the sake of making this site a valuable resource and meeting place for Artists and Art Enthusiasts alike we specifically ask you not to:

Upload frivolous or prank artwork. If you would, we have to remove it at our sole discretion.
Use the site as a store front to sell goods (like golf clubs).
Upload content that is copy protected.
Upload pornography.
Upload hate material.

Agreement for Access to Internet Services

Our Responsibilities: We provide to you under the terms of this Agreement space on the Espectro server with Internet server capabilities where pages of your information, images, and data content will be resident and allow users on the Internet to access this content. Under this option, you may enter your information, images and data content through use of online forms that we provide. We provide software facilities resident on our server to format and load your information, images and data content from the online forms that you complete. We restrict the use of these software facilities and the ability to modify your information and data content to the authorized Username and Password we provide to you. You should be aware that all Internet users will have access to view your information and data, and that it may be possible for these users to gain unauthorized access into the server where your data and image files reside. Access to the Espectro server and the information and data content may be dependent upon resources not under the control of Espectro. We reserve the right to interrupt access to the Espectro server to perform regular and emergency maintenance as needed.

Your Responsibilities: You are solely responsible for all your information, images and data content including its accuracy. You shall defend, indemnify, and hold us harmless against any liabilities arising out of:

any material infringing or allegedly infringing on the proprietary rights (including but not limited to intellectual property rights) of a third party,
any defamatory, libelous or illegal, or allegedly defamatory, libelous or illegal material contained within your information, images and data,
any third party claim arising out of third party access or use of your information, images and data, and
any claim by you that your data was compromised because of a failure to provide adequate security.

Conditions: Immediately upon written or electronic notice we may terminate your authorization to maintain your information and data on our server if you infringe any intellectual property right, copyright, patent, trademark, privacy right, or similar right of another or if you conduct criminal or illegal activities, post, display or transmit obscene, pornographic, or sexually explicit or graphic materials in conjunction with the information and data content you provide. In the case of either party terminating this Service, we reserve the right to maintain one copy for archival purposes only. Both of us agree that neither party is a legal representative, partner, joint venturer, franchisee, or agent for any purpose of the other, unless both parties have signed a separate written business partner agreement. Other than as specified herein, neither party makes any representations, or assumes or creates any obligations, on behalf of the other. You are responsible for invoicing and collection of any monies which you charge for your artwork. You are responsible for ensuring that your information and data does not contain any data or information which violates any law or regulation.
